Crowley (private) prison riot: New details of unheeded warnings emerge in epic lawsuit

Seven years ago inmates at a private prison in southeastern Colorado went on an all-night rampage, chasing the shorthanded staff from the premises, attacking suspected snitches, setting fires and causing millions of dollars in damages. Now documents filed in a long-running legal battle confirm what many prisoners have been saying all along -- that prison officials received ample warning of impending trouble but failed to take action in time.

Arrest of Alleged Murder Suspects

U.S. Marshal Albert Najera, of the Eastern District of California, announced today that the U.S. Marshals Pacific Southwest Regional Fugitive Task Force (PSWRFTF) Fresno Division, arrested 33 year old Jennifer Case, and 39 year old Henry Eliseo Renteria. Both are wanted by the Fresno Police Department for the Murder of 19 year old Michael James Mitchell of Fresno. Renteria was also wanted by the California Department of Corrections and Rehabilitation (CDCR) for violating his conditions of parole.

On December 5, 2011, Michael James Mitchell was found dead, with trauma to his body, in the alley of the 1300 block of E. Harvard Avenue in Fresno. According to Detectives with the Fresno Police Department, the victim and suspect had been involved in a disturbance prior to the murder...

Richmond police seize 9 pounds of cocaine

Richmond police say they have seized 9 pounds of cocaine with a street value of more than $800,000 as part of an investigation that also included three arrests.

The drugs were found along with $335,000 and a firearm during searches of four homes—three in Richmond and one in Alameda—last week. Police announced the seizures on Tuesday...

McFarland man arrested for alleged assault with vehicle

A parolee was arrested Tuesday for allegedly ramming his vehicle into another man.

Jose Guadalupe Alvarado Jr. was arguing with Jose Manual Mendoza outside a business on the 200 block of West Kern Avenue, McFarland police said Wednesday.

Mendoza reportedly made a derogatory gesture at Alvarado, got in his vehicle and drove away. Alvarado followed, and the two stopped and started to argue again about a block away...

Plumas County’s public safety system is already feeling the effects of the state’s Assembly Bill 109 inmate realignment.

Pelican Bay inmate sentenced in guard attack

A Pelican Bay State Prison inmate already serving a life term got another 10 years tacked onto his sentence after he pleaded guilty in a prison guard attack.

Prosecutors say 20-year-old Omar Cardenas and another inmate, Moses Osuna, attacked two guards with handmade weapons in January. A third guard who tried to intervene was also injured....

Prison Realignment Sparks Lively Debate

It’s no surprise that AB109, California’s new inmate transfer bill — or “realignment” — is a contentious issue. Therefore, it was a pleasant surprise when tempers remained relatively calm at a recent conference in Sacramento on this very topic, allowing for a constructive debate to take place between invited panelists and those in attendance.

Sponsored by Capitol Weekly, a California newspaper that focuses exclusively on state government and politics, the all-day event, dubbed “California Prisons: The Good, the Bad and the Ugly” was all that and more. Held at Sacramento’s famed Crest Theater, the well-known challenges of California’s penal system was the topic du jour. Discussions circulated around realignment and its impact on overcrowding, services, prison reform, parole deficiencies and recidivism in four panels comprised of individuals with differing views. The well-attended conference also featured Assemblyman Roger Dickinson, Senator Loni Hancock, and Matt Cate, secretary of the California Department of Corrections and Rehabilitation, as guest speakers....

Parolee arrested after citizen calls tip line

A California state parolee was arrested Wednesday after a citizen called the Humboldt County Sheriff's Office tip hotline to report the his whereabouts.

A citizen called the tip line at 8 a.m. to report that Larry Shawn Johnson, 38, was living in Room 10 at the Fields Landing Hotel. The tipster stated the parolee was preparing to flee to Arkansas, according to a press release from the sheriff's office....

Police search for man connected to Menlo Park shootout

The U.S. Marshals Service and other law enforcement agencies canvassed Mountain View on Wednesday for a parolee who may be connected to last weekend's shootout involving Menlo Park police.

CA State Supreme Court Declines to Hear Case on Corrections Furloughs

The state Supreme Court yesterday denied review of a First District Court of Appeal decision allowing the state to furlough unionized correctional officers.

The court voted 6-0 to allow the ruling in Brown v. Superior Court (California Correctional Peace Officers’ Association), A127292, to stand. The First District’s Div. Two ruled in October that the three-day-per-month furlough program initiated during Gov. Arnold Schwarzenegger’s administration is lawful as applied to facilities manned by employees represented by the California Correctional Peace Officers Association....

Furlough Lawsuit Ends  –  The state Supreme Court this week denied review of a First District Court of Appeal decision allowing the state to furlough Unit 6 correctional officers.  The trial court had ruled in favor of CCPOA which had filed the lawsuit on behalf of the membership.  However, an appellate court reversed the trial court and ruled in October that the three-day-per-month furlough program initiated during Gov. Arnold Schwarzenegger’s administration is lawful.  The state Supreme Court’s ruling allows the appellate decision to stand and concludes this lawsuit in a disappointing manner for the members.  For more on this ruling, please go to the CCPOA website where we have posted the full story.

Health Care Benefits Increased –Unit 6 members will have a little extra money in their paychecks as a result of the 2011 MOU negotiated between CCPOA and the state.  Employer contribution rates will increase, resulting in less money being taken out of employee paychecks to pay for the various health care plans.  Please go to the CCPOA website where we have posted a memo from the EC explaining the different amounts and savings Unit 6 members will receive.

CDCR NEWS

Inmate Recidivism Reduced  –  California’s recidivism rate fell to 65 percent this year, according to the 2011 Adult Institutions Outcome Evaluation Report from the California Department of Corrections and Rehabilitation (CDCR). This significant reduction of 2.4 percentage points in one year equates to 2,766 fewer offenders returning to prison and an approximate saving to California taxpayers of $30 million.  The full report from CDCR is posted for you on the CCPOA website.

Inmate Sentenced in C.O. Stabbing–  A Pelican Bay State Prison inmate already serving a life term got another 10 years tacked onto his sentence after he pleaded guilty stabbing correctional officers earlier this year.  The judge also ordered he pay nearly $40,000 in fines and restitution. Higher Fed Tax Rate For January1 Paychecks–  Because Congress had failed to act by this past Tuesday, the state controller’s office is required to follow IRS mandates and withhold 6.2 percent for the Social Security tax rate.  This will equate to about an extra $2.00 withheld for every $100 earned on paychecks issued on January 1.  Congress has since agreed to restore the lower withholding amount which is expected to be returned to employees and reflected in the February paychecks.  We’ll keep you posted with any developments.

Parolee arrested for stealing weapons

A 21-year-old parolee is in custody on charges of stealing a handgun and knife from a vehicle in Big Bear City.

Robert Standard was arrested Dec. 22 on suspicion of stealing the weapons, according to Detective Lonnie Siebert. Deputies from the Big Bear Sheriff’s Station were notified at 9:59 a.m. Dec. 22 about the missing items from a vehicle in the 400 block of East Country Club Boulevard in Big Bear City. Detectives were aware that Standard, a parolee at large, was in the Big Bear area, and was a suspect in the theft. Standard was wanted on other parole violations as well, Siebert said...

Known gang member stabbed in north Gilroy

A known gang member and parolee was stabbed by multiple men in a north Gilroy gang attack, police said.

Just before 10:15 p.m. Wednesday, the 20-year-old man was walking alone on the 8100 block of Murray Avenue when the attack occurred, police said. After the attack, police received a call from the man saying that he had been stabbed, police said. Police responded to Grant Court to find him lying in the road...

Motel Room Mini-Siege Yields Entirely Predictable Result, Plus Pot Poundage

On Sunday, December 25, 2011, at approximately 11:20 pm, Officers contacted and arrested 35 year old James Bauer of Arcata for a felony warrant for Parole Violation.  That arrest led to a room at a Motel on Valley West Blvd.  In their subsequent investigation, APD Officers contacted and detained an associate of Bauer’s; 21 year old Jarame Johnson of McKinleyville.  Officers determined that Bauer and two associates were renting a room at the motel and were suspected of sales of controlled substances.

Agents from the California Department of Corrections, Eureka Parole Office were contacted and instructed the Officers to search the motel room.  The room had been locked from the inside and the occupant did not cooperate when the Officers announced their presence and asked for them to open the door...

Phillip Lewis, fugitive sex offender, arrested in Rochester

A paroled sex offender from California who had been on the run for more than two years was arrested without incident Friday in Rochester.

Members of the U.S. Marshals Task Force found Phillip Lewis at an apartment in the 1200 block of North Clinton Avenue. He was charged as a fugitive from justice and taken to Monroe County Jail.

Lewis, 54, was wanted by the California Division of Parole for absconding and failure to register as a sex offender...

Parolee charged in mom’s strangling, beating death

A parolee could face the death penalty if convicted of strangling his mother, beating her with a hammer, then hiding her body in the septic tank of her Chico home.

Anthony David Yee was arraigned Tuesday on charges of first-degree murder with special allegations that include robbery and lying in wait.

Prosecutors say the 34-year-old Yee broke into Judith Nathan's house on Dec. 19 and attacked her...

Prison Transportation Officer Killed in Truck Accident

A prison transport officer died in a truck accident in Palm Bay on the early morning of December 20, according to WTSP.com. Reports indicate the 47-year-old male, Officer Jeffrey Farless, died after the van he was driving rear-ended a semi-truck on Interstate 95. The van, owned by a privately contracted company, was nor carrying any other passengers.

“He was dropping an inmate off at the Palm Beach County Jail and was on his way back here,” says US Transport owner Robert Downs. “We’re very saddened. It’s a tough day for us. I’ve known him for over 10 years...”
